There is a crossroads in the attorney vs. paralegal legal market in smaller Los Angeles Santa Monica Long Beach Culver City Inglewood Hawthorne San Fernando Valley Northridge Encino Long Beach Beverly Hills type cities as they are being transformed by the money saving technique of using a paralegal or legal document assistant instead of a high priced lawyer.

Los Angeles County Legal Document Assistants License

The Los Angeles County Recorder’s Office now requires anyone working as a legal document assistant to obtain an LDA license. The process involves first obtaining a $25,000 bond, which costs from $250-500 for two years, and then paying $203 for the LDA license, which is also good for two years. You have to go to the L.A. County Recorders Office in to complete this process. When I applied for mine I had to give the clerk a photocopy of my BA degree from CSUN and also a copy of my UCLA paralegal certificate. Since I did not have letters of proof from my over twenty years of experience both as a paralegal and legal document assistant, the recording clerk “inferred” (without giving legal advice), that I needed to uncheck that extensive experience from my license and I would still qualify. The clerk then takes the applicant’s photograph, creates and issues the card right on the spot. There is an art to obtaining vital information from clerk’s and legal document assistants without making such persons going over the forbidden line and engaging in the unauthorized practice of law. Directly below the license holders name are the words “This Person is Not an Attorney.”

I am moderately surprised that I my license number, LDA-401, is so low. There are a lot of legal document assistants in this county, more than 401 it would seem. It seems such a small price to pay to go legitimate. A lot of clients tell me that they have paid other paralegals, law firms, and legal document assistants and gotten ripped off. My German Shepherd Dharma always tells me that what goes around comes around. This legal document assistants karma is so clean that the other day when I dropped off my van to have a new headliner installed the upholstery man gave me a loaner Infiniti without even asking to see my I.D!

So make sure your legal document assistant is licensed and bonded. And ask to see his L.A. County Photo I.D. Card!

Probate Case with Criminal Charges Against Attorneys Returns!

The Return of the Anna Nicole Smith Case

It's back! Perhaps the most famous probate litigation case ever, Marshall v. Marshall (a/k/a Anna Nicole Smith versus the son of her late 90+year old husband) has been on hold for more than two years, but may be ready for its big comeback. There will be an estimated 20+ paralegals working on this case and the litigation could go in in the probate court for years.

In 2002, former Playboy Playmate of the Year Anna Nicole Smith won a judgment for a whopping $88 million against the son of her late husband for interfering with her inheritance rights. More specifically, two different federal court judges in California ruled in her favor, finding that E. Pierce Marshall, son of the late oil tycoon J. Howard Marshall II, had fraudulently and improperly prevented Howard Marshall from making a substantial gift to Anna Nicole Smith.

In fact, the courts found "overwhelming" evidence that Pierce Marshall's willful, malicious and fraudulent behavior, which included forging documents and lying to his father, justified $44 million in damages, plus another $44 million in "punitive" damages because the behavior was so outrageous.

Interestingly, a Texas probate court had previously held a trial on the same claims between the parties and ruled in favor of Pierce Marshall and against Anna Nicole Smith. Because of the earlier Texas proceedings, Pierce Marshall challenged the rulings of the California federal courts, claiming they lacked jurisdiction to decide the case because it was a "probate" matter. That legal challenge went all the way to the United States Supreme Court (the highest court in our country), which ruled in favor of Anna Nicole Smith in 2006. The high Court determined that the federal courts did have jurisdiction to award the $88 million to Smith.

Before she could collect the money, Pierce Marshall died, in June, 2006. Anna Nicole Smith,of course, then died as well, in February, 2007. Because of Marshall's death, the federal courts imposed a "stay" on the case, freezing it until Marshall's estate could be straightened out.

There the case sat, until this week. On March 9, 2009, Howard K. Stern, on behalf of Anna Nicole Smith's Estate (and for the benefit of her young daughter, Dannielynn) asked the United States Supreme Court to unfreeze the case and lift the stay, allowing the money to be paid. Stern argued that the Pierce Marshall Estate would dispose of its assets, leaving Smith's Estate unable to collect its money.

Interestingly, just a few days after Stern filed the official request, the California Attorney General criminally charged Stern, as well as Smith's doctor, with conspiring to provide Smith with thousands of prescription pills just before her fatal drug overdose. The Attorney General even held a press conference today, during which he described Stern as the "principal enabler" in Smith's prescription drug addiction. If Stern wasn't superstitious about Friday the 13th before today, he must be now!

To make Stern's day even worse, the Supreme Court then denied the request to lift the stay, meaning that the Smith Estate would have to continue to wait to try to collect the $88 million. If Stern's concerns in that case have merit, this means that the Smith Estate faces the possibility of losing out on the money even if it wins the remaining issues on appeal. The Pierce Marshall Estate is trying to overturn the judgment on other legal grounds and feels it does not have to pay the money. Now, the two estates will likely have to wait years before the whole legal mess is finally sorted out.

By then, Stern may be serving a stiff jail sentence. Of course, this is the same Stern who claimed he was actually Dannielynn's father, until DNA testing proved otherwise. Who knows how old Dannielynn will be when -- and if -- the Marshall money is ever paid.

Truly, this is one probate litigation case that has it all. Will contests and trust challenges, claims of undue influence, mental incompetency, fraud, forgery, deceit, lying, cheating, criminal drug overdosing, and of course the tantalizing sexual exploits of one very filthy rich old man. And there are still years of fighting left.

U.S. Government Help for Los Angeles Homeowner's

Mortgage holders with condos in foreclosure in Playa Vista may stay on as renters

Freddie Mac, the government-sponsored mortgage finance institution, said on January 30, 2009 that it would allow some borrowers whose houses are in foreclosure in the State of California to remain in their homes as renters.

The new policy's direct effect will be modest. Freddie Mac has only about 8,500 properties in foreclosure, and many are vacant in Inglewood, California. Nationwide, various estimates place the number of homes in foreclosure at more than 2 million. But economists and fair housing advocates in Santa Monica, California say the policy could be a model for a broader program to expand into the San Fernando Valley to enable turned-out borrowers to rent their homes.

Homes in nice areas like Culver City abandoned after foreclosure often become eyesores as lawns die, repairs are not performed and, in some cases, vandalism occurs, especially in areas like Hawthorne and Lawndale. Local officials say such properties can hurt overall property values in their neighborhoods, especially in Van Nuys, California.

"Keeping foreclosed properties occupied and in better repair will support local property values and promote a faster recovery in the housing market," said Freddie Mac Chief Executive David M. Moffett.

The Freddie Mac program would change market-rate rents. And, with rents falling in many cities like Playa Vista and Beverly Hills, the homeowners turned tenants would generally pay far less per month than their old mortgage payments.

Freddie Mac will also allow tenants living in rental property that has been foreclosed upon to stay put with month-to-month leases.
